WitterBrick Terms

1. This is a Contract. Witter Coin (“we”, “us”) is a direct sale merchant of rare coins, bullion and other related products (individually or collectively, “item(s)” or “coin(s)”). All orders and sales of WitterBricks from us are subject to these terms and conditions, and purchasing items from us is deemed acceptance by you (“Buyer” or “you”) of all terms and conditions stated herein, as an agreement or contract between you and us.
2. CAC Grading. All coins currently are being authenticated, graded and certified by CAC Grading (“CACG”) in accordance with, and subject to, their standard policies and practices, available on their website (currently found here www.cacgrading.com/legal/gradingpolicy). WitterBrick is not responsible for the grades assigned and makes no warranty or representation regarding such grades. CACG is an independent third party and is not the seller of the items nor a guarantor of their value. By purchasing a WitterBrick, you are transacting solely with us.
3. Custom Labels. Buyer acknowledges that they will receive CACG graded coins which may bear customized or limited edition WitterBrick labels, currently signed by our founder Seth Chandler. We currently offer several different special labels, but reserve the right to change or cease these special labels from time to time. We do not guarantee that these special labels have any added value.
4. Registry. We currently offer a registry system for our coins. Our Registry is meant solely for the enjoyment of the collecting community, for each participant’s personal entertainment only, and not for commercial or other purposes. Points, leaderboards, rankings, medals, accomplishments, and other milestones have no cash or other value, and we do not offer any no prizes nor other benefits for any of them (other than mere “bragging rights”).
5. Boxing Process. The specific coins vary by box. The boxes are packaged with CACG graded coins and built based on values from an independent third party, Greysheet’s Collector’s Price Guide (as described in section 6), using a methodology to ensure that each box has coins making up a minimum value based on the CPG value. The system is designed so that there may be different types and price points of coins within each box. The boxes are sealed at the CACG secure facility and aren’t numbered individually before distribution and fulfillment. This is done by design so neither we nor anyone will know which customer is receiving which specific coins or bricks – some will be more valuable than others, and we use good faith efforts to randomize this.
6. Independent Third Party Values. We rely on an independent third party price guide, currently, Greysheet’s Collector’s Price Guide (CPG) published values, as determined at the time of boxing. Coin values vary over time and the listed CPG value at the time of boxing is no guarantee of CPG value at the time of receipt, or unboxing, or at any future point in time. We do not control the accuracy of CPG price estimates or guides. Third party value lists are no guarantee of actual value or resale. Some coins may sell for more or less than their third party listed values.
7. Buyer Acknowledgements. Buyer acknowledges and understands that the rare coin market is speculative, volatile and unregulated, and that coin prices may rise or fall over time. WitterBrick does not offer investment advice and does not guarantee that items will be able to be sold for cost or for a profit in the future. Contents of the box are for entertainment and collector purposes; we do not offer investment advice, and any potential increase or decrease in value of the items is not guaranteed or foreseeable. We do not guarantee that the items included in the box will retain their value, or that they can be resold for a profit. The value of rare coins can fluctuate based on market conditions, and past performance does not predict future results. The company shall not be responsible or liable for any financial loss incurred due to purchasing this product. Buyers assume all risks related to the market value of the items included in this box. The company is not liable for any changes in value. WitterBrick does not itemize the purchase price of each of the coins within the total purchase price for each box. Buyer acknowledges and agrees that the purchase price paid is for the box as a whole (including value adds) and not any individual coins. WitterBrick does not guarantee the minimum value of any given coin will equal or exceed any itemized portion of the WitterBrick purchase price. WitterBrick does not guarantee that the resale value of any given coin will equal or exceed the value of said coin at the time of purchase of a WitterBrick.
8. Value Adds. Buyer acknowledges and agrees that the purchase price of each WitterBrick may include value other than the value of the coins therein. For example, without limitation, special labels, the ability to participate in the registry, sample slabs, other branded items, the collectible nature of the boxes, entertainment value, that the coin(s) are graded according to CACG’s system, and other incremental value adds.
9. Shipping. Items will be shipped to the address you give to us. WitterBrick reserves the right to not ship purchased items until payment for the items and any other outstanding balance owed to WitterBrick, including other invoices, attorneys’ fees, collection costs and interest, is made in full. WitterBrick retains the right to ship using a variety of shipping companies and you may be required to sign for your package. Because WitterBrick itself does not know the specific contents of each box, WitterBrick will self-insure each box in the amount of the purchase price of the box (regardless of the actual contents), for loss, theft or damage of coins during shipment. WitterBrick makes no warranty or representation regarding the adequacy of insurance coverage it provides. Any claim by Buyer for loss or damage (1) shall be limited to the purchase price of the box paid by the Buyer, and (2) must be made in writing to WitterBrick no later than ten (10) days from the WitterBrick ship date. In the event of a claim, Buyer must comply with all information requests and requirements from WitterBrick, including but not limited to, returning damaged boxes to WitterBrick.
10. Payment. Payments are due at time of purchase. Your purchase is not complete until you pay in full. All sales are subject to availability. Boxes can sell out at any time, even if you have already added one or more boxes to your online shopping cart. All sales are final. We do not offer guarantees or buy backs. We may elect to purchase registry items on a case by case basis. Payment by credit card can carry a service fee. Buyer acknowledges and agrees that WitterBrick may engage one or more third parties to collect customer data for purposes of insuring against chargebacks, customer analytics and future marketing. See our Privacy Policy as referenced below.
11. Sales Tax. California residents may be charged sales tax. Residents of states other than California should consult their tax advisor as to the applicability of sales and use tax in their states. International Clients: Duties may be assessed by your country’s customs office and are the sole responsibility of the Buyer.
12. E-Commerce Terms. Buying a WitterBrick is an e-commerce purchase from our website and is therefore also subject to any applicable web terms and conditions and policies, such as our Terms of Service (currently found here) and Privacy Policy (currently found here here). Our return policy is stated on our Terms of Service. We may from time to time post additional and/or different return policies on the WitterBrick website.
13. NO WARRANTY, EXPRESSED OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, IS MADE IN RESPECT TO ANY ITEM EXCEPT FOR WARRANTY OF TITLE. ALL ITEMS ARE SOLD “AS IS” AND WITH ALL FAULTS. PURCHASER HEREBY ASSUMES ALL RISKS CONCERNING AND RELATED TO THE VALUE OF THE ITEMS.
14. WitterBricks are being sold in the USA under US laws and targeted at and intended for US buyers subject only to US laws. You must be over 18 to purchase.
15. We reserve the right to update these terms at any time. Use of the word “currently” means at the time of the last update to these terms.
